5.Company's explanation of the reportage or provided information:Fractus S.A (“Fractus”) filed a lawsuit against the Company in the Eastern District Court of Texas, USA on May 5, 2009, alleging that the Company infringed nine Fractus patents, which are related to Antenna patents. In the complaint, Fractus also sued nine other handset manufacturers and distributors, including Samsung, LG, RIM, Pantech Wireless, Kyocera, HTC, Sharp, Sanyo, UTStarcom, and PCD. Our preliminary study indicates that the patents-in-suit are not the Company’s core technology. This patent infringement lawsuit will not impact the Company’s core competency, current customers in USA or devices already on sale in USA. The Company will retain outside counsel to represent the Company in this lawsuit.
