The District Court of Mannheim has today (December 18) ruled that it will stay proceedings regarding the two IPCom patents (EP 1 222 782 and EP 1 186 189) because the Court has serious doubts about their validity. The cases will be stayed pending invalidity proceedings at the European Patent Office and the German Federal Patents Court respectively.
The European Patent Office has already confirmed that patent EP 1 222 782 is invalid in a preliminary finding. Decisions from the European Patent Office and the Federal Patents Court are expected in 2010.
HTC welcomes this decision as it is consistent with a recent series of other findings of invalidity against IPCom patents. These decisions have vindicated HTC’s view that IPCom patents are invalid and are not infringed by HTC products.
